TERMS AND CONDITIONS OF LOVELA CLUB MEMBERSHIP

1.SUBJECT

The "Member" who approves this Agreement and fulfils the conditions set forth in these Terms and Conditions shall be entitled to privileges and discounts by accumulating LovEla points for his/her accommodation expenditures at the Ela Excellence Resort Belek facility of Aktay Otel İşletmeleri A.Ş. ("Hotel").

The LovEla program is based on providing privileges and discounts to the Member and it is not about spending the points accumulated by the Member, but about the Members having different statuses as regulated by these Terms and Conditions. Therefore, there shall be no payment or transfer of points in currency to the Member or spending of points by the Member.


2.LOVELA PROGRAM

Within the scope of the LovEla program, Members will be categorised as "LovEla Gold", "LovEla Platinum", "LovEla Diamond" or "LovEla Star" according to their LovEla points and will be entitled to the privileges in the attached FLYER within the scope of the category they are in and they will be able to benefit from their reservations made through


the Ela Hotels website https://www.elahotels.com/,


Ela Resort App and


Ela Hotels Call Centre (444 1 352)

 

and their expenses within the Ela Excellence Resort Belek Hotel. According to this


If the Member has spent at least €600 or more on accommodation at Ela Excellence Resort Belek, he/she will become a Gold Card holder and will be able to benefit from the opportunities granted to this status.


If the Member has spent at least €10,000 or more on accommodation at Ela Excellence Resort Belek, he/she will become a Platinum Card holder and will be able to benefit from the opportunities granted to this status.


If the Member has spent at least €50,000 or more on accommodation at Ela Excellence Resort Belek, he/she will become a Diamond Card holder and will be able to benefit from the opportunities granted to this status.


If the member has spent at least €100,000 or more on accommodation at Ela Excellence Resort Belek, he/she will be entitled to a Star Card and will be able to benefit from the opportunities granted to this status.


The privileges granted to the Member within the scope of each status are specified in the Flyer attached to these Terms and Conditions and the Hotel may unilaterally change the status and privilege conditions and scope at any time. The Member waives in advance his/her right to object to any changes to be made in these Terms and Conditions, status and privilege conditions and scope.


3. MEMBERSHIP TERMS

3.1. All natural persons over the age of 18 can become a member of the LovEla program if they comply with the rules regarding their personal status.


3.2. Membership is not open to legal entities or other groups or associations.


3.3. It is not possible for more than one person to submit a joint application, for Members to combine or transfer LovEla points, or for the same person to submit more than one application.


3.4. Membership of the LovEla program starts when the person who wishes to become a LovEla member fills in the membership form and accepts these general terms and conditions or when he/she performs his/her first activity using his/her temporary card. The hotel is not obliged to accept every application and may reject membership requests without giving any reason.


3.5. In case of the death of the member, the membership ends automatically.


3.6. The stated discount rates refer to the minimum number of nights of accommodation to be realised, reservations that do not meet this requirement are not granted discount privileges.

 

3.7. Accommodation Discount in the Upper Room Category is the discount rate that the guest who has checked in to the Hotel will receive over the room price differences applied by the Hotel in the upper category room type requests. It is not the discount rate to be given directly to the Member over the room rates.


3.8. Based on the Member's LovEla status with the LovEla points earned by the Member, the Booking Privileges Discount request can be processed in the Member's next accommodation expenditure. The Hotel will evaluate accommodation requests according to the Hotel's availability and may offer different dates, room types or services to the Member. The advantages, benefits and facilities offered under the LovEla program may be subject to date, quota and service limitations and other restrictions determined by the Hotel. The Hotel may make additional arrangements and changes regarding the acquisition and use of certain services.


3.9. Persons who apply to participate in the LovEla program may benefit from the privileges offered to the Member as soon as they make their application, provided that they are finally accepted to the program.

 

4.    LOVELA POINTS

 

4.1. The Member will earn LovEla points based on the accommodation expenditure and the points earned will be credited to the Member's account on the check-out date. The number of LovEla points credited to the Member's Membership account shall be determined in accordance with the LovEla program conditions in force on the date of the accommodation expenditure that is the basis for earning LovEla points. The Hotel has the sole discretion over these terms and conditions, and the Hotel may change LovEla points earning and the category, benefits and conditions of the Membership at any time. Therefore, the earning of LovEla points by the Member does not constitute a vested right for the Member in terms of the category and benefits and conditions.


4.2. Regardless of the currency, the accommodation expenditure will be converted into Euros at the CBRT Euro buying rate on the day of payment and will be registered in the Member's account as 1 LovEla point for 1 Euro. The LovEla points are valid for 36 months. At the end of this period, the Member will lose the privileges that he/she has based on LovEla points.


4.3. LovEla points earned in relation to accommodation will be added to the Member's account, provided that the person making the payment is a Member of the program, and the Member will benefit from the privileges and discounts granted to the Member. In this context, the LovEla points will be added to the account of the Member who pays for the "accommodation expenditure" even if more than one person stays in a single room sale. Provided that the Member does not receive any benefit (in cash or in kind), the privileges and discounts granted to him/her may be made available to any person staying with him/her, provided that he/she makes the relevant reservation himself/herself.


4.4. Due to the nature of the program, LovEla points provide advantages such as privileges and discounts to the Member for the expenditures to be made at Ela Excellence Resort Belek or for the reservations to be made through the Ela Hotels website https://www.elahotels.com/, Ela Resort App and Ela Hotels Call Centre (444 1 352), but do not provide any payment opportunity.


4.5. All privileges offered within the Program are based on the status of the Member according to the number of LovEla points accumulated after joining the LovEla Program.


4.6. Each Member will receive a personal LovEla "Membership Account" in which all LovEla points earned will be stored. LovEla points are non-transferable, LovEla points of multiple people, whether they are Members or not, cannot be collected in the same account, and cannot be combined with the Membership accounts of other LovEla members in order to gain or upgrade status. LovEla points are redeemed as specified in the program and no cash equivalent will be provided. The Hotel reserves all rights of disposition in determining the status and the conditions of use of LovEla points.


4.7. The Hotel is the sole authority to determine whether the Member is entitled to LovEla points by assessing the Member's LovEla balance and any disputes regarding the Member's participation in the program and reserves the right to cancel or prevent the registration of LovEla points if it believes that LovEla points have been incorrectly credited to the Member's account. The Hotel reserves the right to charge the Member who has benefited from privileges, discounts and benefits by using the points and status incorrectly credited to his/her account or to take other legal action to recover its losses.


4.8. The Hotel accepts no responsibility for any taxes, duties, extra charges, and extra fees incurred by its Members and third parties in connection with the LovEla program and these Terms and Conditions.

 

5.    MEMBERSHIP REGISTRATION AND NOTIFICATIONS

5.1. The LovEla Membership Terms and Conditions will be made available for the guest's approval on the https://www.elahotels.com/ website, Ela Resort App or at the entrance of the Hotel. Members can access the statuses applied within the scope of the LovEla program and the privileges, discounts and advantages granted to Members with these statuses, tables showing the LovEla points they belong to and detailed information via the website https://www.elahotels.com/ and Ela Resort App. The hotel reserves the right to make changes to these tables and membership specifications.

 

5.2 Each member is given a personal security code "PIN code" that enables personal identification. The PIN code is a special password that the member will use in all online transactions. By using the PIN code, it is possible to save the rights within the scope of the program. The transaction made with the correct PIN code is deemed to be a transaction made by the Member. For this reason, for the security of their accounts and to prevent malicious use, members are responsible for preventing the PIN code from being given to third parties and ensuring its confidentiality. The PIN code is notified by the Hotel only upon the request of the member and the Hotel cannot be held responsible in any way for its use by persons other than the member. In case the member suspects any misuse of the PIN code or that the PIN code has been learned by unauthorised persons, it is obligatory to inform the authorised units of the Hotel specified in our information documents as soon as possible without wasting time. If this notification is not made on time or at all, the Hotel will be liable only in case of intent and gross negligence. Members can access the current LovEla program conditions, Membership information and LovEla balances via the ElaResort.com website and Ela Resort App by entering their PIN code and member card number. Members are also not sent any documents by e-mail or post.

 

5.3 The Hotel will make notifications and announcements regarding the program via Ela Resort App and https://www.elahotels.com/ website. Members are obliged to follow these announcements and notify the Hotel of any changes in their telephone and e-mail details. The Hotel is not responsible for members not being aware of notifications and announcements due to not updating their personal information, not following the Ela Resort App or https://www.elahotels.com/ website.

 

5.4 Members may not make any payment or other claims under any name for any damages they may incur due to the non-receipt of notifications for any reason whatsoever.


6.    TERMINATION

Members may withdraw from the LovEla program at any time by submitting a written application without any notice period. The Hotel may terminate the Member's contract and membership at any time without giving reasons and without liability for compensation by giving a two-week notice period. In the presence of a just cause, the notice period shall not be complied with. The Hotel may suspend the contract and/or the Hotel may terminate the contract immediately, without any notice period, without prejudice to any other right of compensation or remedy, in which case the Hotel shall not be liable to the Member for any claims, damages, LovEla points, bookings or other obligations whatsoever.


- The Member has grossly breached the terms and conditions of the LovEla program, the program conditions set out in the LovEla program terms and conditions and other Hotel documents, as well as the booking form, the Agreement and its annexes relating to the Hotel's accommodation services,


- The Member has provided false information (e.g. age of the persons staying, dates of stay) or has used the LovEla program in violation of the rules and the law,


- The member; verbally or actually attacking, teasing, harassing the Hotel staff, other guests and members, acting contrary to the instructions of the staff on duty during the stay, damaging the property or life of the Hotel or other guests at the Hotel, third parties or Hotel staff, engaging in transactions and actions

contrary to the law, disrupting the order of the Hotel and the peace of people,


The Hotel has the right of unilateral discretion to suspend, cancel or terminate the Membership for the reasons stated above, and the Hotel reserves the right to apply for any legal remedy, demand, complaint in addition to this right.


In case the membership agreement is terminated by the Member in any way, the Hotel reserves the right to claim all kinds of damages.

In the event that the membership of the Member is terminated by the Hotel for just cause, the Hotel may blacklist the Member, remove the Member from the LovEla program, delete his/her points, and deem the points earned partially or completely invalid, without prejudice to any rights regarding the excess, at the discretion of the Hotel. The Member irrevocably agrees to this. In this case, the Hotel reserves the right to apply for all kinds of legal remedies from the Member and to claim all kinds of material, moral, direct and indirect damages.


7.    PERSONAL DATA

The Hotel may use the Member's information accessed within the scope of Membership and program participation and required for the execution of the program, within the scope of the program, and may send it to program partners and related institutions. With the start of membership, consent is given to the use of personal information within the specified scope. In this context (GDPR provisions are applied to the extent appropriate) LPPD Clarification and Explicit Consent Texts are submitted for the Member's approval in this Membership Specification Delivery Form. By becoming a Member of the Program, the Member declares that he/she accepts these conditions.


8.    RESOLUTION OF DISPUTES

The interpretation and application of these LovEla Membership Terms and Conditions, the LovEla Program and its annexes and the settlement of disputes shall be governed by the laws of the Republic of Türkiye and Serik Courts and Enforcement Offices shall be competent for the settlement of disputes. However, the Hotel reserves the right to file a lawsuit in other competent courts specified in the law.

These LovEla Membership Terms and Conditions are effective as of 01 May 2024. The Flyer regarding membership categories, privileges and discounts is an annex and integral part of this Agreement.
