Cancellation policy
It can be canceled free of charge up to 7 days before the day of arrival. For cancellations made less than 7 days beforecheck-in, 30% of accommodation fee will be charged.
Check-in time is 14:00 and check-out time is 12:00.
Online Booking and Distance Sales Contract

(Hereinafter referred to as “GUEST”)
2.SUBJECT
This contract regulates the rights and obligations of the parties regarding the accommodation service and its accessories sold by the Hotel to the Guest, the qualifications and the sales price indicated herein.
3.BASIC PROPERTIES OF THE CONTRACTUAL SERVICE AND PAYMENT INFORMATION
3.1.The type of service, date, sales price, payment method, and guest data are indicated in the booking form.
3.2.The total accommodation fee must be paid in full at the time of booking for the booking to be confirmed. If the price fails to be collected, the booking shall be cancelled on the system.
3.3.The rates are inclusive of VAT and accommodation tax. The Hotel shall accept credit cards or bank transfers/EFT. The guest shall pay the contract price through the mobile application and/or website. The invoice shall be delivered to the Guest physically or via e-mail upon check-out from the Hotel.
3.4.The total cost of the accommodation must be paid to confirm the booking. The bookings shall be processed not when they are made but when the cash payment is made, the necessary amounts are collected from the credit card account, or the electronic funds transfer (EFT) arrives in the bank accounts. If the booking fee is underpaid, the Hotel shall cancel the booking and claim all damages incurred due to the cancellation from the Guest.
3.5.Since only the credit cards of the Banks are used for deferred and instalment sales, the Guest acknowledges, declares, and undertakes that he shall independently confirm the applicable interest rates and information on default interest and the provisions related to interest and default interest shall be imposed under the credit card agreement between the Bank and the Guest in accordance with the provisions of the applicable legislation.
3.6.The Hotel accepts Visa, Mastercard, American Express, and credit cards for payments and reserves the right to pre-authorise payments.
3.7.If a refund is demanded for the accommodation, the cost of which was paid for at the time of booking through credit card or bank transfer, the refunds are paid to the bank account that the Guest indicates in writing on the request form, or to the bank account from which the transfer or EFT was made. If the Hotel has made any extra payments to banks and/or financial institutions, regardless of the name under which, such as commissions, charges, etc., due to the refund process, the refund shall be given by deducting such costs from the refund amount. No cash refund shall be made to the Guest.
4.RIGHT OF WITHDRAWAL &CHANGE
4.1.The Guest may withdraw (cancel) or change the booking before the accommodation begins without prejudice to the conditions set out herein. Concordantly,
4.1.1.If the notice of withdrawal is served 3 (three) days before the check-in date or earlier, the room fee for three days in High Season (01 May - 30 September) and one day in Low Season (01 October - 30 April) shall be calculated at the rate of the first check-in date and the total amount of the accommodation fee shall be refunded.
4.1.2.If the notice of withdrawal is served 2 (two) days before or after the check-in date, no refund shall be granted.
4.1.3.For booking changes, the request must be submitted to the Hotel 3 (three) days before the check-in date, and the Hotel must confirm the request. The booking may only be upgraded, and the Hotel shall collect any extra costs incurred. The Hotel reserves the right to refuse the request of the Guest to change the booking based on the availability of the Hotel.
4.1.4.If the Guest checks in late to the Hotel without a notice of withdrawal, cancellation or change in the booking, the cost for the days not accommodated shall not be refunded
4.1.5.The total amount of the accommodation fee shall be refunded for notice of withdrawal 21 (twenty-one) days before the check-in date for the room types: Ela Family Suite, Deluxe Suite, Excellency Suite, Premier Suite, Penthouse Suite, Prestige, Ela Villa, Sultan Villa. For notice of withdrawal to be served later than 21 (twenty-one) days based on the check-in date, the entire accommodation cost shall be accrued and collected from the Guest as a no-show fee.
4.2.If the Guest or his first-degree relatives are unable to stay at the Hotel due to a condition that has been authenticated by an official board report of at least ten (10) days from a full-fledged state hospital, or if the Guest or his/her first-degree relatives die and the circumstance is notified in writing to the Hotel with an official letter before the accommodation begins, the Hotel shall impose no sanctions for /cancellation/withdrawal. Other cases shall be exempted from the right of withdrawal according to paragraph 15/1-g of the Regulation on Distance Contracts, and no refund shall be made.
4.3.Requests and applications shall be made via e-mail to be sent to the Hotel ([email protected]), via the guest user account on the web or via the call centre.
4.4.The Hotel shall review the request within fourteen days from the receipt date of the notice that the Guest has exercised his/her right of withdrawal and, if deemed appropriate, shall refund all payments collected to the Customer.
5.CANCELATION OF THE BOOKING
5.1.If the Guest prefers to leave the Hotel early after the beginning of his/her stay, the room fee for three days in high season (01 May - 30 September) and for one day in low season (01 April - 30 April and 01 October - 31 October) shall be accrued as a no-show fee by being calculated over the room rate on the first check-in day due to cancellation, and charged to the Guest.
5.2.Any request and application for the cancellation shall be sent to the HOTEL through the electronic mail [email protected]. The Hotel shall review the request within fourteen days from the receipt date of the notice on the cancellation request of the guest and, if deemed appropriate, shall refund all payments collected from the guest.
6.FORCE MAJEURE
6.1.Any circumstances that are neither available nor foreseen when the contract was signed, that are beyond the control of the Hotel, that make it impossible for the Hotel to fulfil its contractual obligations and responsibilities wholly or partially or to fulfil them on time, shall be deemed to be force majeure (Acts of God, war, terrorism, uprising, seizure or strike, lockout, etc.).
6.2.If it is determined that the contractual service was not delivered due to any force majeure or justifiable cause for the Hotel and/or there is an availability constraint, the Guest shall be immediately notified clearly and straightforwardly. In such a case, the Guest shall be notified, the total amount paid shall be refunded to him within fourteen (14) days at the latest, and the contract shall be terminated. In such a case, the Guest agrees and declares that he/she shall make no further claim for any additional pecuniary and non-pecuniary damages against the Hotel.
7.GENERAL TERMS
7.1.No pets shall be allowed in the Hotel.
7.2.A discount shall be applied to children if they stay in the same room with their parents. The authenticity of the Guest’s identity data shared during the booking registration process shall be confirmed by the identity check made by the authorised person when checking-in and registering at the Hotel. The identity card must be submitted upon request. If there is an inconsistency in the child’s identity as disclosed during the booking process, the authorised person shall change the booking, and the Guest shall be charged for the difference in rates. The Guest shall be responsible for any missing or misstated identity.
7.3.The check-in and check-out times are 14.00 and 12.00 respectively. The Hotel shall not be obligated to deliver a room before the check-in time. Late check-outs shall be charged at the half-day rate until 18.00, and the check-outs after 18.00 shall entitle the hotel to charge at the full-day rate.
7.4.If the Customer makes an extra request, the Hotel shall hold no responsibility. The hotel shall do its best to accommodate requests within its capabilities. The Hotel reserves the right to charge for extra services. The Hotel shall collect the agreed upon sum in cash or by credit card on the day of departure from the Customer.
7.5.The Guest agrees that the information provided in the Booking Form is correct and complete. The Customer shall be liable for any damages arising from incomplete or inaccurate data.
7.6.The Hotel shall assume no responsibility for any content, visual or price errors that may arise due to the system, system error, design or illegal actions that may be taken on the website or the Customer`s negligence.
7.7.No failure or delay by the Hotel in exercising any contractual right, power or privilege hereunder shall operate as a waiver thereof, nor shall any separate or partial exercise of any right, power or privilege preclude any other or further exercise thereof or the exercise of any other right, power or privilege.
7.8.The Guest accepts, declares and undertakes that the official ledger and commercial records, as well as the electronic data and computer logs that the Hotel keeps in its own database and servers, shall be binding, conclusive and exclusive evidence in disputes arising from this Contract.
7.9.The laws of the Turkish Republic shall govern this contract, and the disputes arising out of this contract shall be resolved by the arbitration provisions of Law No. 6502 on the Protection of Consumers in determining the courts of competent jurisdiction. The Guest can file his applications for complaints and objections to the consumer arbitration committee or consumer court in the place where the consumer (guest) resides or where the consumer procedures are followed within the monetary limits set in the Law.
8.ENFORCEMENT
The Guest, by approving this Contract electronically, acknowledges that he/she has been informed by the Hotel clearly, comprehensibly and in accordance with the service on all preliminary information related to the service such as the Hotel’s title, complete address, telephone and other access data, the basic qualities of the contractual service, the price to be paid, payment method, service conditions and costs, taxes and additional fees, and the use of the right of “withdrawal” and how to exercise such right, the official authorities to which he/she can deliver his/her complaints and objections, the rights and obligations he/she holds, that he/she has approved this preliminary information electronically and has accepted the terms and conditions set out herein and in its annexes.
Preliminary Information Form
This Preliminary Information Form (“Preliminary Information Form”) relates to the provisions of the Turkish Code of Obligations No. 6098, the Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation published in the Official Journal No. 29188 on 27.11.2014, to inform the Customer by regulating the rights and obligations of the parties regarding the service subject to the Distance Sale offered by the Hotel and the qualifications set out herein.

The type of service, date, sales price, payment method, guest details, accommodation provided, and details are as stated below and in the booking form.
Payment Terms: The total accommodation fee must be paid in full at the time of booking for the booking to be confirmed. The system shall cancel the booking if the price fails to be collected.
Terms and Conditions:
• Room check-in time begins at 14:00.
• Room check-out time is before noon.
• No pets are allowed.
• For bookings over five rooms, different conditions shall prevail.

1.1.1. Other Considerations
The Hotel shall not be liable for any promotional or pricing errors that may occur as a consequence of website system and design or unlawful website intrusions. The Customer shall assert no claim against the Hotel on the grounds of system failure.
Turkish Law shall govern any disputes between the parties, and the provisions of Law No. 6502 on the Protection of Consumers shall prevail in determining the court of competent jurisdiction and mediation provisions. The customer can file his applications for complaints and objections to the consumer arbitration committee or consumer court in the place where the consumer (guest) resides or where the consumer procedures are followed within the monetary limits set in the Law.
The Guest, by approving this form electronically, acknowledges that he/she has been informed by the Hotel clearly, comprehensibly and in accordance with the service on all preliminary information related to the service such as the Hotel’s title, complete address, telephone and other access data, the basic qualities of the contractual service, the price to be paid, payment method, service conditions and costs, taxes and additional fees, and the use of the right of “withdrawal” and how to exercise such right, the official authorities to which he/she can deliver his/her complaints and objections, the rights and obligations he/she holds, that he/she has approved this preliminary information electronically, and has accepted the service according to the provisions set out herein and in its annexes.
